Welcome to MedInsider Shop. These Terms of Use (“Terms”) govern your access to and use of MedInsider Shop, including our website, online store, content, products, features, and related services (collectively, the “Platform”).

Unless expressly stated otherwise, such information is not intended to constitute:

6. Orders

Placing an order through MedInsider Shop constitutes an offer to purchase the selected product or products.

An order confirmation does not necessarily constitute final acceptance of an order. We reserve the right, subject to applicable law, to refuse or cancel an order in circumstances including:

A product becoming unavailable
Incorrect product or pricing information
Payment authorization failure
Suspected fraud or unauthorized activity
Incorrect or incomplete delivery information

If payment has already been received for an order that we cancel, the applicable amount will be refunded in accordance with our refund procedures and the relevant payment provider’s processing timelines.

Product prices are displayed on the Platform in Indian Rupees unless otherwise stated.

Applicable taxes, delivery charges, or other fees, if any, will be displayed during the purchasing process where appropriate.

We may change product prices at any time. A price change will generally not affect an order already accepted by us, except where correction is required because of an obvious pricing or technical error and as permitted by applicable law.

Customers must use one of the payment methods made available through MedInsider Shop.

We reserve the right to cancel or hold an order where a payment cannot be verified or where there is a reasonable suspicion of fraudulent or unauthorized activity.

9. Shipping and Delivery

Orders are shipped to the delivery address provided by the customer during checkout.

Customers are responsible for providing a complete and accurate delivery address and valid contact information.

Estimated delivery dates or timelines are estimates and may be affected by factors beyond our reasonable control, including courier delays, weather conditions, public holidays, natural events, transportation disruptions, government restrictions, or incorrect delivery information.

Our Shipping Policy, as published on MedInsider Shop, forms part of these Terms where applicable.

10. Returns, Replacements, Cancellations, and Refunds

Returns, replacements, cancellations, and refunds are governed by the policies published on MedInsider Shop and applicable law.

Certain healthcare, personal-use, hygiene-sensitive, or sealed products may be subject to restrictions on returns after opening or use, where permitted by law.

Images and illustrations owned by us

is owned by, licensed to, or lawfully used by MedInsider Technologies (OPC) Private Limited and is protected by applicable intellectual property laws.

You may use the Platform for personal and lawful purposes only.

You may not, without appropriate authorization, reproduce, copy, distribute, republish, modify, commercially exploit, scrape, systematically extract, or create derivative works from protected Platform content, except where permitted by applicable law.

Third-party trademarks and product names remain the property of their respective owners.

13. Acceptable Use

You agree not to use MedInsider Shop to:

Commit or facilitate fraud

Your statutory rights as a consumer remain unaffected.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify MedInsider Technologies (OPC) Private Limited against reasonable losses, liabilities, and expenses arising directly from your unlawful use of the Platform, deliberate violation of these Terms, or infringement of third-party rights.

This provision does not apply to the extent that a loss results from our own acts or omissions or where such an obligation cannot legally be imposed.

20. Suspension and Termination

We may suspend or terminate access to the Platform where reasonably necessary due to:

A material violation of these Terms
Fraudulent or unlawful activity
Security threats
Misuse of the Platform
Legal or regulatory requirements

Termination or suspension of access does not affect rights or obligations that arose before such action.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to any mandatory rights or jurisdiction available to consumers under applicable law, disputes arising from these Terms or the use of MedInsider Shop shall be subject to the jurisdiction of the competent courts in Navi Mumbai, Maharashtra, India.

Nothing in this section restricts a consumer from exercising rights available under applicable consumer protection laws.
